These Terms of Use ("Terms") govern your access to and use of the website audienceshift.life (the "Site") operated by AudienceShift Pte. Ltd. (UEN 202427591W), a company registered in Singapore with its registered address at 32 Club Street, #02-01, Singapore 069416 ("AudienceShift", "we", "us" or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

These Terms apply to website visitors and general users. If you engage AudienceShift for paid marketing services, a separate written service agreement, statement of work, or retainer contract will govern the commercial relationship and will prevail over these Terms to the extent of any inconsistency regarding deliverables, fees, timelines, and service-level commitments.

1. What AudienceShift is — and what our name means

AudienceShift Pte. Ltd. is a professional audience development and growth marketing agency based in Club Street, Singapore. We help client brands understand, reach, and grow their marketing audiences through research, strategy, content, paid and organic channel management, creative direction, and performance reporting.

Our name and domain carry specific meanings on this Site and in our communications. Please read this section carefully to avoid misunderstanding what we offer:

  • "Audience" means marketing audiences — the groups of people a brand seeks to reach, engage, and convert through planned media, content, and campaign activity. It does not mean a live event audience in a venue, a television broadcast viewership guarantee, a generic "target market" promise, or any assurance that content will reach a particular number of people.
  • "Shift" means moving, evolving, or growing marketing audiences — for example, expanding reach into a new segment, improving engagement quality, or migrating attention from one channel to another through deliberate strategy. It does not refer to an employee work shift, shift scheduling software, shift handover processes, data migration in a CRM system, or any software-as-a-service product that "shifts" records between databases.
  • ".life" is part of our domain branding on audienceshift.life. It does not indicate that we provide life coaching, wellness programmes, personal development courses, lifestyle advice, health guidance, or spiritual counselling. We are a B2B marketing services firm, not a wellbeing or self-help provider.

Nothing on this Site should be interpreted as offering HR technology, roster management tools, customer-relationship-management subscriptions, marketing automation SaaS licences, financial products, investment advice, or get-rich-quick schemes. AudienceShift performs professional marketing work for clients under contract — we are not a software vendor, not a training bootcamp, and not a media publisher selling ad inventory directly to consumers.

2. Permitted and prohibited use

You may use the Site for lawful personal or business purposes, including learning about our services, reviewing case material, and submitting genuine enquiries through our contact channels. You agree not to:

  • Use the Site in any way that violates applicable laws or regulations in Singapore or your jurisdiction;
  • Attempt to gain unauthorised access to our servers, databases, or connected third-party systems;
  • Introduce malware, automated scraping bots, denial-of-service traffic, or other harmful code;
  • Copy, reproduce, republish, or commercially exploit Site content without our prior written consent, except for limited personal reference or sharing of public URLs;
  • Misrepresent your identity or affiliation when contacting us or submitting forms;
  • Use Site content to imply an endorsement, partnership, or client relationship that does not exist;
  • Harvest personal data of other users or our staff through the Site.

We reserve the right to restrict or terminate access for conduct that we reasonably believe breaches these Terms or harms the Site, our business, or other users.

3. Intellectual property

All content on the Site — including text, graphics, logos, photographs, page layouts, design elements, typography, and underlying code — is owned by AudienceShift Pte. Ltd. or used under licence, and is protected by copyright, trademark, and other intellectual property laws. The AudienceShift name and visual identity are trading identifiers of AudienceShift Pte. Ltd.

You receive a limited, non-exclusive, non-transferable, revocable licence to view and temporarily download portions of the Site for personal, non-commercial use. This licence does not permit modification, reverse engineering, bulk extraction, or creation of derivative works. Case study metrics, creative samples, and portfolio descriptions are presented for illustration; underlying client assets remain the property of respective clients unless otherwise stated.

4. Enquiries and no automatic engagement

Submitting a contact form, email, or telephone enquiry does not create a client relationship, obligation to provide a proposal, or commitment to accept a project. All engagements require mutual agreement on scope, fees, timelines, and terms documented in a written contract. We reserve the right to decline enquiries that fall outside our expertise, ethical guidelines, capacity, or permitted industries described in our FAQ.

5. No guaranteed audience growth, leads, or ROI

AudienceShift provides marketing and audience development services. Marketing outcomes are inherently variable. We do not guarantee specific results, including but not limited to:

  • Audience size, reach, impressions, or share of voice at any particular level;
  • Follower growth, engagement rates, or viral distribution;
  • Search engine rankings or organic visibility positions;
  • Lead volume, marketing-qualified lead counts, or sales pipeline contribution;
  • Conversion rates, revenue, profit, or customer lifetime value;
  • Return on advertising spend (ROAS), return on investment (ROI), or cost-per-acquisition (CPA) targets;
  • Press coverage, influencer amplification, or award recognition.

Any metrics, benchmarks, cohort analyses, case study figures, or performance ranges mentioned on the Site, in proposals, or in conversations are illustrative of past work, industry context, or planning assumptions. They are not promises, warranties, or earnings claims. Actual outcomes depend on factors outside our direct control, including your budget, product-market fit, competitive landscape, seasonality, platform algorithm changes, creative quality, landing-page experience, sales follow-up, and macroeconomic conditions.

Testimonials, anonymised case studies, and sample dashboards show the type of work we perform. They must not be read as guarantees that similar results will occur for you. Make engagement decisions based on documented scope and your own due diligence.

6. User submissions

If you submit content through our contact forms or email — including briefs, brand materials, or feedback — you represent that you have the right to share that content and that it does not violate third-party rights or applicable law. You grant AudienceShift a non-exclusive licence to use submitted materials solely for the purpose of responding to your enquiry or delivering agreed services. We do not claim ownership of your pre-existing intellectual property.

7. Third-party platforms and links

The Site may reference or link to third-party platforms such as Google, Meta, LinkedIn, TikTok, analytics providers, or industry publications. These references describe tools we may use in client work; they do not imply official partnership status unless explicitly stated. Third-party sites have their own terms and privacy policies. We are not responsible for their content, availability, or data practices. Your use of third-party services is at your own risk and subject to those providers' terms.

8. Privacy and cookies

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect and process personal data under Singapore's Personal Data Protection Act. By using the Site, you acknowledge those policies. Where non-essential cookies are used, we obtain consent through our cookie banner before activation.

9. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by Singapore law. Without limiting the foregoing, we do not warrant that:

  • The Site will be uninterrupted, error-free, or free of harmful components;
  • Information on the Site is complete, current, or suitable for every purpose;
  • Any defects will be corrected within a particular timeframe.

We may update, suspend, or remove pages, service descriptions, or indicative pricing at any time without notice. Archived copy may not reflect current offerings.

10. Limitation of liability

To the maximum extent permitted by applicable law, AudienceShift Pte. Ltd. and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site — even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these Terms or your use of the Site (excluding liability that cannot be excluded under Singapore law) shall not exceed SGD 100. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless AudienceShift Pte. Ltd. from any claims, losses, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Singapore, except where mandatory consumer protection laws in your home jurisdiction provide otherwise for non-waivable rights.

13. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when the current version took effect. Material changes will be posted on the Site. 14. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and AudienceShift regarding use of the Site, superseding prior oral or written understandings on that subject.
